After the implementation of the provisions of Ministerial Decision No. 16228/2017 in application of Law 4442/2016, the use of music or musical instruments inside and/or outside a shop or a business of sanitary (health) interest is permitted upon notification. This may occur either through the submission of a New Notification of Operation (for a new establishment or for an existing one to which an adjacent space is added), or through the submission of a Change of Notification of Operation (for an existing business that does not hold a valid licence for the use of music or musical instruments), without exception.

Notification must be submitted through the platform www.notifybusiness.gov.gr of the General Secretariat of Industry of the Ministry of Economy and Development, without the payment of a fee and without the need for the issuance of an Updated Certificate of Installation.

In the case of using music or musical instruments in an outdoor area of a shop or business of sanitary interest, in accordance with paragraph 2, Article 7 of Ministerial Decision No. 16228/2017, it is specified that:

“…at the site of installation, a TECHNICAL REPORT must be available to the control authorities, prepared by an engineer specialized in soundproofing and acoustics or another appropriately qualified professional. This report must be drawn up in accordance with the relevant health regulations.”
