A. Certificate of Establishment of a Health Care Establishment or Business of Health Interest

The granting of the permit concerns the approval of land use; in no case is it a permit for the operation of the shop or business of sanitary interest and is required in the case of a new establishment or addition of an adjacent space to an existing business.

Required documents:

• Application

• Declaration of authority according to art.8 of Law 1599/1986 if the application is submitted by a third person

• Responsible declaration of art.8 of Law 1599/1986:

  • The businessman – tenant in case there is a regulation in the building that allows the operation of the specific activity

  • The owner of the premises – landlord in case there is no regulation in the building. If there is co-ownership of the premises, Affidavits must be submitted by all co-owners with reference to their percentage

• Printed map of the area (indicatively you can use the Google Maps application) showing the block where the shop or business of sanitary interest is located, its number, and the surrounding streets

• A recent electricity bill from the electricity provider or any document showing the electricity supply number

It is granted within fifteen (15) days and is valid for five (5) months, during which time the fee for the establishment of a shop or business of sanitary interest must be paid to our service and the Notification of its operation must be submitted on the website www.notifybusiness.gov.gr of the General Secretariat of Industry of the Ministry of Economy and Development (see next sections).

B. Updated Certificate of Establishment of a Health Care Establishment or Business of Health Interest

The granting of the permit concerns the approval of land use; in no case is it a permit for the operation of the shop or business of sanitary interest and is required in the following cases:

• Addition/change of activity

• Change of operator

• Change of name – corporate form provided that the VAT number remains the same

• Change of legal representative

• Addition of an external adjacent area (private green space or public municipal space)

• Settlement – legalization of arbitrary buildings

Required documents:

• Application

• Declaration of authority according to art.8 of Law 1599/1986 if the application is submitted by a third person

• Responsible declaration of art.8 of Law 1599/1986:

  • The businessman – tenant in case there is a regulation in the building that allows the operation of the specific activity

  • The owner of the premises – landlord in case there is no regulation in the building. If there is co-ownership of the premises, Affidavits must be submitted by all co-owners with reference to their percentage

• Printed map of the area (indicatively you can use the Google Maps application) showing the block where the shop or business of sanitary interest is located, its number, and the surrounding streets

• Establishment and operating licence/certification of operation of the previous operator (required only in case of change of operator)

• A recent electricity bill from the electricity provider or any document showing the electricity supply number

• Valid Establishment and Operating License / Authorization of operation (required only in cases of addition/change of activity and/or addition of external adjacent space and/or regularization – legalization of unauthorized premises)

It is granted within ten (10) days and is valid for five (5) months, during which time the fee for the establishment of a shop or business of sanitary interest (only in the case of addition/change of activity) must be paid to our service and the Change of Notification of Operation must be submitted on the website www.notifybusiness.gov.gr of the General Secretariat of Industry of the Ministry of Economy and Development (see following sections).

C. Notification of the operation of an Establishment or Establishment of Health Interest

After the implementation of the provisions of the Decree No. 16228/2017, pursuant to Law 4442/2016, the operation of a new shop or business of sanitary interest (new establishment) or the operation of an existing shop or business of sanitary interest to which an adjacent space is added, is permitted after the submission of a New Notification of Operation on the website www.notifybusiness.gov.gr of the General Secretariat of Industry of the Ministry of Economy and Development and after having a mandatory complete file of supporting documents in the form of a new establishment or business of sanitary interest.

Detailed instructions on how to submit a New Notification of Operation of a shop or business of sanitary interest can be found on the website www.notifybusiness.gov.gr of the General Secretariat for Industry of the Ministry of Economy and Development.

Change of Notification of Operation of an Establishment or Establishment of Health Interest

After the implementation of the provisions of the Decree No. 16228/2017, in application of Law 4442/2016, the Change of Notification of Operation of a shop or business of sanitary interest is submitted to the website www.notifybusiness.gov.gr of the General Secretariat of Industry of the Ministry of Economy and Development each time any element concerning its operation is changed, while it is mandatory to keep a complete file of supporting documents at the physical premises, including the granted – in specific cases – notification of operation of a shop or business of sanitary interest.

Indicatively, it is submitted in cases where the change concerns:

• Use or cessation of use of music and musical instruments (updated Installation Certificate not required)

• Add/change activity

• Change of operator

• Change of name – corporate form provided that the VAT number remains the same

• Change of legal representative

• Change of store manager (no need for an updated Installation Certificate)

• Addition of an external adjacent space (no Updated Installation Certificate required)

• Settlement – legalization of arbitrary buildings (no need for an updated Certificate of Installation)

• Change of size factor (Updated Installation Certificate not required)

• Change any information related or not related to a certificate

Detailed instructions on how to submit a Change of Notification of Operation of a shop or business of sanitary interest can be found on the website www.notifybusiness.gov.gr of the General Secretariat of Industry of the Ministry of Economy and Development.

D. Notification of the use of music or musical instruments in a Store or Establishment of Health Interest

After the implementation of the provisions of the No. 16228/2017 CAA in application of Law 4442/2016, the use of music or musical instruments inside and/or outside a shop or a business of sanitary interest is permitted if notified, either after submission of a New Notification of Operation (for a new establishment or an existing establishment to which an adjacent space is added), or after submission of a Change of Notification of Operation (for an operating business that does not have a valid Licence for the use of music or musical instruments), for no reason, on www.notifybusiness.gov.gr of the General Secretariat of Industry of the Ministry of Economy and Development, without the payment of a fee and the issuance of an Updated Certificate of Installation.

In case of use of music or musical instruments outside (in an outdoor area) of a shop or a business of sanitary interest according to paragraph 2 of No.7 of No.16228/2017 KYA, it is specified that:
“…at the site of the installation will be available to the control authorities a TECHNICAL REPORT of an engineer specializing in soundproofing and acoustics or another scientist of relevant specialization, which will be drawn up in accordance with the health provisions.”

E. Authorization to extend the hours of use of music and musical instruments in a Health Care Establishment or Business of Health Interest

The use of music or musical instruments in a shop or a business of sanitary interest beyond 22:00 during the winter period (from 1/10 to 31/3) or 23:00 during the summer period (from 1/4 to 30/9) requires, according to paragraph 3 of article 29 of Law 4442/2016 and corresponding provisions of paragraph 3 of article 7 16228/2017, the issuance of an Extension of Hours of Use Permit for Music or Musical Instruments which is valid for one (1) year and extends the use of music or musical instruments with a maximum sound level of 80db with closed doors and windows both in the Winter and Summer periods for the days Friday, Saturday, Sunday and the eve of holidays until 02:00 and for the other days of the week until 01:00.

According to article 285 of Law 3463/2006, a necessary condition for the issuance of the notice is:
“…the absence of confirmed arrears against the person concerned, with the exception of cases of pending litigation and the settlement of payment of these, in accordance with the relevant legislation.”
